Terms and Conditions

1. Introduction- These Terms and Conditions ("Terms") govern the provision of services by Accessible Travel Malta powered by Unlock Your pOTential Ltd. to the person requesting or receiving our services. By requesting our services, you will be completing and submitting the Client Registration Form. Any consent relating to the processing of special category personal data is governed by the Company's separate Special Category Personal Data Consent Form. These Terms should be read together with our Privacy Policy, Special Category Personal Data Consent Form, and any applicable Disclaimers or other documents provided to you by the Company.

2. The Service - Accessible Travel Malta provides personalised, practical and informational guidance to clients visiting Malta. Our service is intended to assist clients in making informed choices regarding accommodation, locations, activities, transport, places of interest and other matters relevant to their visit, taking into account the information, preferences and requirements provided by the client. The precise nature and scope of the service provided will depend upon the information supplied by the client and the service requested. We may undertake reasonable research, consider information reasonably available to us, and provide personalised recommendations or guidance based on that information. Unless expressly agreed otherwise in writing, Accessible Travel Malta does not act as a travel agent, tour operator, medical provider, healthcare provider, occupational therapist, accessibility assessor, safety certifier, accommodation provider, transport provider or activity provider. Our role is limited to providing the advisory and informational service described in these Terms.

3. The Process The service generally begins with the client completing and submitting the Client Registration Form, alongside the Special Category Personal Data Consent Form and Privacy Policy. The information provided is reviewed for the purpose of understanding the client's individual requirements, preferences and circumstances. Where appropriate, we may seek clarification or further information from the client before providing our recommendations. Following this process, the Occupational Therapist or Nurse will contact the client to plan an online meeting to be able to provide personalised information, guidance and recommendations concerning accommodation, locations, activities, transport, accessibility considerations and other matters relevant to the client's visit. The process may vary depending upon the nature of the client's requirements and the service requested. Clients can also opt to purchase the specialised guide book. The provision of recommendations does not constitute a guarantee that the client will choose, book or use any particular accommodation, activity, location, facility or service. The client remains responsible for making their own final decisions.

4. Information Provided by the Client - The client is responsible for ensuring that the information provided to Accessible Travel Malta is accurate, complete and up to date. The quality and relevance of our recommendations depend upon the accuracy and completeness of the information supplied to us. The client agrees to notify us if any information relevant to their requirements changes after the Client Registration Form has been completed. The service is entitled to rely upon information provided by the client and shall not be responsible for consequences arising from information that is inaccurate, incomplete, misleading or no longer current. The client should provide only information that is relevant to the provision of our service. The client is not required to provide medical diagnoses, medical records, medication details or other medical information unless such information is specifically requested by us and is reasonably necessary for the provision of the service.

5. Consent - Where information provided by the client constitutes special categories of personal data under applicable data protection legislation, including information concerning health, mobility or physical requirements, such information will only be processed in accordance with the requirements of applicable data protection legislation. Where Accessible Travel Malta relies upon consent for the processing of special category personal data, the client will be asked to provide separate and explicit consent through the Company's Special Category Personal Data Consent Form. The client may withdraw consent at any time in accordance with the applicable Consent Form and Privacy Policy. The withdrawal of consent will not affect the lawfulness of processing carried out before consent was withdrawn. However, withdrawal of consent may affect our ability to provide certain aspects of the personalised service where the relevant information is reasonably necessary for that service.

6. Data Protection - Accessible Travel Malta will process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR"), applicable Maltese data protection legislation and any other applicable data protection requirements. Personal data will be collected and processed for purposes connected with the provision and administration of our services, including understanding the client's requirements, preparing personalised recommendations, communicating with the client, maintaining appropriate records, complying with legal obligations and protecting our legitimate interests where applicable. Further information concerning how personal data is collected, used, stored, shared and retained, together with information concerning the client's data protection rights, is provided in our Privacy Policy. The Privacy Policy should be read together with these Terms and Conditions and the applicable Consent Form.

7. Advisory Nature of Service Accessible Travel Malta - Provides an advisory and informational service only. Any information, guidance, recommendation, observation or assessment provided by us is intended to assist the client in making their own informed decisions and should not be regarded as professional medical, clinical, therapeutic, healthcare, occupational health, safety or other professional advice. In particular, any information we provide concerning mobility, walking distances, steps, terrain, accessibility, accommodation facilities or activities is based on information available to us at the relevant time and on the information supplied by the client. Such information does not constitute a medical assessment, accessibility certification, safety assessment or guarantee that a particular option is suitable or safe for the individual client.

8. Recommendations and Third Party Services - In providing our service, we may provide information or recommendations concerning accommodation providers, restaurants, transport providers, activity providers, excursion operators, attractions, venues, public facilities and other third-party businesses or organisations. Accessible Travel Malta does not own, operate or control such third-party services unless expressly stated otherwise. We therefore cannot guarantee the availability, quality, accessibility, suitability, condition, safety or continued provision of any third-party service or facility. Information concerning third-party services may change without notice. Facilities, opening hours, prices, transport arrangements, routes, accessibility features, staffing, restrictions and other circumstances may change after information has been provided to the client. The client should therefore make their own enquiries and, where appropriate, confirm relevant information directly with the third-party provider before relying upon it. Any contract entered into between the client and a third-party provider is between those parties. Unless expressly agreed otherwise in writing, Accessible Travel Malta is not a party to that contract and is not responsible for the performance, acts or omissions of the thirdparty provider.

9. Accessibility and Individual Suitability - Where the Company provides information relating to accessibility, mobility or practical suitability, that information is intended to assist the client in making further enquiries and informed decisions. Accessibility and suitability may be affected by circumstances outside our control, including weather, crowds, road and pavement conditions, construction, maintenance, temporary closures, changes to facilities, changes to transport arrangements and other changes affecting a location or service. Accordingly, Accessible Travel Malta does not certify or guarantee that any particular accommodation, location, route, activity, facility, transport arrangement or other service is accessible, suitable or safe for the client. The client remains responsible for determining whether a particular option is appropriate for their individual circumstances and should independently verify any information that is particularly important to them.

10. Accuracy and Changes - We aim to ensure that information provided by us is reasonably accurate and current at the time it is provided. However, we rely in part upon information obtained from third parties and other sources, and we cannot guarantee that all information will remain accurate or unchanged. The client acknowledges that circumstances may change between the time a recommendation is provided and the time the client travels or uses a particular service. Such changes may include alterations to accommodation facilities, transport schedules, opening hours, routes, accessibility arrangements, activities, prices or other conditions.

11. Client Responsibility - The client remains responsible for making their own enquiries, assessments and decisions regarding whether a particular accommodation, location, activity, facility, route, transport arrangement or third-party service is appropriate for their individual circumstances. The client acknowledges that Accessible Travel Malta cannot know every aspect of the client's circumstances and that recommendations are based on the information provided to us and information reasonably available to us at the relevant time. Nothing in our service removes the client's responsibility to exercise reasonable care, follow applicable instructions and restrictions, comply with third-party terms and conditions, and seek appropriate professional advice where required.

12. Fees and Payments - Unless otherwise agreed in writing, the Company will require payment immediately after each online session, visit or relevant service. Third-party costs, including accommodation, transport, activities, admission fees, meals, excursions or other purchases, are not included in the Company's fees unless expressly stated otherwise. Where a client fails to make a required payment, the Company may suspend or decline to continue providing the service until the outstanding payment has been received. If payment continues to remain unpaid, we reserve the right to take appropriate steps to recover the outstanding amount in accordance with applicable Maltese law.

13. Limitation of Responsibility - Accessible Travel Malta shall not be responsible for loss, damage, injury, delay, inconvenience, expense or other consequences arising from circumstances outside our control or from the acts or omissions of third parties. This includes, without limitation, changes to accommodation, facilities, activities or transport services; inaccurate or outdated information supplied by third parties; temporary closures; construction or maintenance; weather or environmental conditions; traffic or road conditions; public transport disruption; changes to accessibility arrangements; or the failure of a third-party provider to provide a service as expected. The Company shall also not be responsible for consequences arising from inaccurate, incomplete or misleading information provided by the client, or from the client's failure to make enquiries or verify information where such verification was reasonably necessary.

14. Confidentiality - Accessible Travel Malta will treat information provided by the client as confidential, subject to our obligations under applicable data protection legislation and our Privacy Policy. We will not disclose the client's personal information to third parties for the purpose of providing our service. Information may only be disclosed where the client has expressly authorised such disclosure or where disclosure is required or permitted by law.

15. Retention of Data and Erasure - Accessible Travel Maltawill retain personal data and records relating to the client only for as long as reasonably necessary for the purposes for which the information was collected, subject to any applicable legal, regulatory, accounting, insurance or dispute-resolution requirements. The client may have the right to request access to, correction or erasure of personal data, or restriction of processing, in accordance with applicable data protection legislation. Such rights may be subject to legal exceptions or limitations. Further information concerning retention periods and the circumstances in which personal data may be erased or retained is provided in our Privacy Policy.

16. Forms and Duplicate Copies - All forms, declarations, consent forms, acknowledgements and other documents required to be completed or signed by the client shall, where applicable, be completed and signed in duplicate, with one copy retained by Accessible Travel Malta and one copy provided to the client. Where a form or document is completed electronically, the Company may retain an electronic record of the completed document and provide the client with an electronic copy.

17. Complaints - If the client has a concern or complaint regarding the service, they should contact the Company as soon as reasonably practicable and provide sufficient information for the matter to be investigated. The Company will consider complaints fairly and seek to respond within a reasonable period.

18. Entire Terms - These Terms and Conditions, together with the Client Registration Form, Special Category Personal Data Consent Form, Privacy Policy, applicable Disclaimers and any specific written agreement between the Company and the client, form the framework governing the relationship between the Company and the client in relation to the services provided. The client confirms that they have had an opportunity to read these documents and raise any questions before proceeding with the service.

19. Amendments - Accessible Travel Malta may update these Terms from time to time where reasonably necessary to reflect changes in the law, regulatory requirements, services or business practices. Where an amendment materially affects an existing client's rights or obligations, the Company will provide appropriate notice. The version of these Terms applicable to a particular service will generally be the version in force when that service is agreed.

20. Law - These Terms shall be governed by and interpreted in accordance with the laws of Malta.
